This Privacy Policy (“Policy”) of Onramp Funds ("Onramp Funds", “Company”, “we”, “us”, and/or “our”) describes in greater detail our privacy practices and how we collect and maintain certain information about you. This policy applies to information (including personally identifiable information (“PII”)) we collect when you register, apply for financial products, access our website, products, and services, or when you otherwise interact with us (collectively, the “Services”). As used in this Privacy Policy, the term “Site” includes all websites and all devices or applications operated by Onramp Funds that collect PII from you, and their respective pages, forms, equivalents, mirrors, replacements, and backups, and all other pages and forms associated with each such website, device, or application.

Your access to and use of the Services is also subject to our Terms of Service and additional product-specific agreements related to specific financing activities mutually entered into by you and Onramp Funds.

As used in this Privacy Policy, the terms “you” and “your” refer to you, the user of Onramp Funds’ website, Services, and products, as the party agreeing to the terms of this Privacy Policy. By visiting our site and accessing information regarding our Services, you hereby agree to this Privacy Policy.

We respect the privacy of businesses and their owners or principals and are committed to protecting the information that you provide, directly in connection with your use of our Site or indirectly through third parties, to obtain Services from Onramp Funds. We may amend this Privacy Policy from time to time by posting a revised, dated version on the Site.

Information We Collect

In your use of the Site and Services, we collect either directly or indirectly, the following types of information:

  • Information regarding a business (“Business Information”)
  • Information about the business’s owners and principals (“User Information”)
  • General information that is automatically collected as you interact with our Site and Services (“General Information”)

In order to provide Services, we collect Business Information from users, including, but not limited to business name, address, phone, email, age, size, revenue, business type, incorporation date, bank and financial account information, sales channel information (online shopping carts, marketplaces, and other sales channels), sales enablement channel information pertaining to inventory, advertising, fulfillment, shipping, and payments, payment processing procedures, accounting information, and other vendor service information. We also review personally identifiable User Information, PII, that consists of but is not limited to the owners’ or principals’ name(s), mailing address(es), email address(es), telephone number(s), date(s) of birth, and social security number(s).

Sales channel information sources, sales enablement channel information sources, fulfillment information sources, shipping information sources, and payment information sources may collect downstream customer data (customer data about your customers). Onramp Funds does not collect or store data about your individual customers and does not collect the PII of these downstream customers from any source.

We collect both User and Business Information from you when you register on our Site, fill out forms or fields on the site, complete applications for products and services available from us, or communicate with us via telephone, email, mail, facsimile, or other means. In the course of providing our Service(s), we may collect additional User Information or Business Information from third parties, including, but not limited to, referral partners, integration partners, identity verification services, mailing list providers, credit bureaus, and publicly available sources, and may combine this information with the information you provide to us and/or that we already have about you.

General information is collected by us from your computer, mobile device, or other access device when you use our Site, view content about the Site, or open emails or links in emails from us. This General Information includes, but is not limited to, information about the equipment you use to access the site, usage details, your internet connection and ISP, your access device(s) operating system, browser, other device details, IP address, your mobile device’s unique identifier, your mobile network information, web pages and advertisements you view, and information you search for on our Site. As per most websites, we gather certain information automatically and store it in log files, which may include, but is not limited to, internet protocol addresses (IP addresses), browser type and version, internet service provider (ISP), referring and exit pages, pages and files viewed on our site, operating system, device type (e.g., desktop, tablet, mobile, etc.), date and time stamps, and/or other click stream data. We reserve the right to link this automatically collected data to other information we collect about you.

We and our business partners, affiliates, analytics, and other service providers use cookies and similar technologies to analyze trends and site usage, administer the Site and Services, track user engagement and activities within the website, and to gather demographic information about our user population. We may receive reports based on the use of these technologies on either an individual or aggregated basis.

Our use of analytics software allows us to better understand the functionality of our Site(s), application(s), and Service(s). This software may record information such as how often you use the Services, the events occurring when you’re on the Site or within the application(s), aggregated data, performance data, and other information pertaining to your use.

Use of Collected Information

In order to establish a safe, easy-to-use, efficient, and customized experience that allows users to take full advantage of our products and services through the Site(s), we use the Business Information, User Information, and General Information we collect to:

‍Information Sharing and Disclosure

We take privacy seriously and only share information as described in this Privacy Policy or as required by United States Federal Law or State, Territory, and/or local laws of the fifty States and Territories of the United States. We may share any of the information we have about you with business partners, service providers, and other third parties per the following terms:

  • To support business operations, including, but not limited to, Site(s) customer services, fraud detection and prevention, secure data transmission and storage, and similar services. These providers are authorized to use your PII only as necessary to provide services.
  • To provide the products and Service(s) for which you provided us information or for other purposes disclosed by us to you when you provided the information to us.
  • To third parties with your consent in order to offer the Service(s).
  • To protect and secure your data from fraud, illicit access, unauthorized use, claims or liabilities, or for resolving disputes or inquiries.
  • To comply with federal, state, territory, or local laws, rules, and other applicable legal requirements and regulations, to comply with properly authorized civil, criminal, or regulatory investigations, subpoenas, summons, bankruptcy notices by federal, state, or local authorities, or to respond to judicial process or government regulatory authorities that have jurisdiction over us for examination, compliance, or other purposes as authorized by law.
  • To the extent permitted or required under other provisions of laws to law enforcement, the Federal Trade Commission, or self-regulatory organizations for an investigation related to public safety.
  • To a buyer or other successor in the event of an acquisition, merger, divestiture, restructuring, reorganization, dissolution, or other transfer of all or a portion of our business or an operating unit.
  • To advertising and marketing platforms and partners (for example, Google) that help us promote our products and services. We may provide these platforms with contact identifiers such as name, email address, and phone number (including in hashed form) so that they can match those identifiers to their own users and deliver advertising for our products and services to you and to audiences with similar characteristics. These platforms are contractually restricted from using the information for their own independent purposes. You may opt out of this use of your information as described in the “Do Not Sell or Share My Personal Information” and state-specific sections below.

We may share individual or aggregated Business Information or User Information, subject to your opt-out, with our business partners, including for jointly offered products and services, under agreements that restrict our business partners' use of the information and require business partners to follow similar policies to protect your data’s privacy and security and comply with the same laws and regulations that we follow.

We may also use, sell, license, or distribute General Information (i.e., non-personally identifiable information) or personally identifiable User Information that has been anonymized so that the information does not identify a specific user without restriction, including, but not limited to, for producing data analytics and reports for business partners or others.

No mobile Opt-in Data will be shared with third parties/affiliates for marketing/promotional purposes. All the above categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.

Protection of Information

We protect User Information and Business Information by using reasonable physical, electronic, and procedural safeguards in compliance with applicable federal and state regulations. We use computer safeguards such as firewalls and data encryption using Transport Layer Security (TLS) technology. We also limit access to User Information and Business Information to employees who need the information to fulfill their job responsibilities. Such employees are provided access to User Information and Business Information only to the extent necessary to complete their job duties.

We store and process information using third-party servers located in data centers within the United States. By using our Site and Services, you agree that we may transfer your information to the third-party service providers with whom we have contracted, to store and process your data in the United States. Although we will comply with our legal obligations to maintain the privacy of PII, we cannot guarantee the confidentiality or security of your information after it has been delivered via the internet or other methods to us.

Do Not Track

Our Site does not respond to Do Not Track signals.

Opt-out preference signals (Global Privacy Control). Separate from Do Not Track, some browsers and browser extensions transmit a Global Privacy Control (“GPC”) signal. Where our Site receives a GPC signal from your browser, we treat it as a request to opt out of the sale or sharing of personal information associated with that browser and device. Because a browser-based signal reaches only the browser and device it is sent from, you may also submit a request as described under “Do Not Sell or Share My Personal Information” below so that we can apply your choice to the contact information we hold for you.

Your California Privacy Rights (CCPA/CPRA)

This section applies to California residents and supplements the rest of this Privacy Policy. It is provided under the California Consumer Privacy Act, as amended by the California Privacy Rights Act (together, the "CCPA"). Terms used in this section have the meanings given to them in the CCPA.

Notice at collection — categories of personal information we collect. In the past 12 months, we have collected the following categories of personal information:

  • Identifiers (e.g., name, postal address, email address, phone number, IP address, government identifiers such as SSN/EIN where applicable);
  • Personal information categories listed in the California Customer Records statute (e.g., name, contact information, financial/bank account information, signature);
  • Commercial information (e.g., financing history, products or services obtained, and transaction records);
  • Internet or other electronic network activity (e.g., interactions with our Sites and Services);
  • Geolocation data (approximate location derived from IP address);
  • Professional or employment-related information (e.g., business role of owners and principals);
  • Inferences drawn from the above to create a profile reflecting preferences or characteristics; and
  • Sensitive personal information, which for us may include a government identifier and financial account information, used only for permitted business purposes.

Sources. We collect this information from you directly, from your use of our Sites and Services, from your business's connected sales channels and financial accounts, and from third parties such as credit bureaus and service providers.

Purposes. We use this information to provide and service financing, evaluate applications, prevent fraud, comply with legal obligations, operate and improve our Sites and Services, and communicate with you, as further described in this Privacy Policy.

Disclosure of personal information. In the past 12 months, we have disclosed the categories above to service providers, our affiliates, financial institution partners, credit bureaus, advertising and marketing platforms, and others as needed to provide our Services and as permitted by law.

Sale or sharing of personal information. We do not sell your personal information in exchange for money. We do share personal information — specifically, identifiers such as your name, email address, and phone number — with third-party advertising platforms and partners, including Google, so that they can match those identifiers to their own users and deliver advertising for our products and services to you and to audiences with similar characteristics. Under the CCPA, this activity is treated as “sharing” personal information for cross-context behavioral advertising. The categories of personal information involved are identifiers, and the categories of third parties that receive them are advertising platforms, advertising networks, and marketing service providers. We do not share sensitive personal information for cross-context behavioral advertising, and we do not sell or share the personal information of consumers we know to be under 16 years of age. You may opt out at any time, as described under “Do Not Sell or Share My Personal Information” below.

Your California rights. Subject to certain exceptions, California residents have the right to:

  • Know/Access the categories and specific pieces of personal information we have collected, the sources, the purposes, and the categories of third parties to whom we disclose it;
  • Delete personal information we have collected from you;
  • Correct inaccurate personal information;
  • Opt out of the sale or sharing of personal information for cross-context behavioral advertising, as described under “Do Not Sell or Share My Personal Information” below;
  • Limit the use and disclosure of sensitive personal information to permitted purposes; and
  • Non-discrimination for exercising your rights.

How to exercise your rights. You (or an authorized agent) may submit a request by email to support@onrampfunds.com. We will verify your request by email, and we will respond within the timeframes required by the CCPA (generally 45 days, extendable by an additional 45 days on notice). We do not charge a fee to process most requests.

Do Not Sell or Share My Personal Information. You may opt out of our sharing of your personal information for cross-context behavioral advertising at any time, and we will not require you to create an account in order to do so. To opt out, email support@onrampfunds.com with the subject line “Do Not Sell or Share My Personal Information” and include the email address and phone number you would like us to suppress. We will act on your request within 15 business days, direct our advertising partners to stop using your information for advertising purposes, and confirm by email once your request has been honored. You may also send an opt-out preference signal from your browser, as described under “Do Not Track” above. We will not discriminate against you for exercising this right.

Authorized agents. You may use an authorized agent to submit requests on your behalf, subject to our verification of the agent's authority.

Retention. We retain personal information for as long as necessary to fulfill the purposes described in this Policy and to meet legal, tax, accounting, and regulatory requirements. 

SECTION B — Other State Privacy Rights (Virginia, Colorado, Connecticut, Utah, Texas, and others)

Additional US State Privacy Rights

If you are a resident of a US state that has enacted a comprehensive consumer privacy law — including Virginia, Colorado, Connecticut, Utah, Texas, and others as they take effect — you may have some or all of the following rights, subject to that state's law and its exceptions:

  • Access/Confirm whether we process your personal data and obtain a copy of it;
  • Correct inaccuracies in your personal data;
  • Delete personal data we have collected;
  • Portability — obtain a copy of your data in a portable format;
  • Opt out of targeted advertising, the sale of personal data, and certain profiling, to the extent we engage in those activities.

Targeted advertising and sale of personal data. We do not sell personal data in exchange for money. We do process personal data — including identifiers such as name, email address, and phone number — for targeted advertising, including by sharing those identifiers with third-party advertising platforms such as Google so that they can deliver our advertising to you and to audiences with similar characteristics. Under some state privacy laws, this activity may also be treated as a “sale” of personal data. You may opt out of targeted advertising and of any sale of your personal data at any time by emailing support@onrampfunds.com with the subject line “Opt Out of Targeted Advertising.” Where our Site receives a recognized universal opt-out preference signal, such as Global Privacy Control, we treat it as an opt-out request for that browser and device.

How to exercise your rights. Submit a request to support@onrampfunds.com. We will respond within the timeframe required by applicable state law (generally 45 days).

Right to appeal. If we decline to act on your request, you may appeal our decision by contacting us at support@onrampfunds.com. We will respond to your appeal within the period required by applicable law and, where required, provide information on how to contact your state Attorney General if you have concerns about our decision.

Your Texas Privacy Rights (TDPSA)

This section applies to Texas residents and supplements the rest of this Privacy Policy. It is provided under the Texas Data Privacy and Security Act (“TDPSA”). Terms used in this section have the meanings given to them in the TDPSA.

Targeted advertising and sale of personal data. We share personal data — including identifiers such as name, email address, and phone number — with third-party advertising platforms, including Google, so that they can deliver advertising for our products and services to you and to audiences with similar characteristics. We therefore process personal data for targeted advertising, and, depending on how the term is applied, this activity may also constitute a sale of personal data under the TDPSA. We do not sell sensitive personal data, and we do not sell biometric personal data.

Your Texas rights. Subject to the exceptions in the TDPSA, Texas residents have the right to confirm whether we are processing their personal data and to access that data; to correct inaccuracies in their personal data; to delete personal data provided by or obtained about them; to obtain a copy of their personal data in a portable and readily usable format; and to opt out of the processing of personal data for targeted advertising, the sale of personal data, and profiling in furtherance of a decision that produces a legal or similarly significant effect.

How to exercise your rights and opt out. Email support@onrampfunds.com with the subject line “Texas Privacy Request,” or, to opt out of targeted advertising or the sale of personal data, “Opt Out of Targeted Advertising.” We will respond within 45 days and may extend that period by an additional 45 days where reasonably necessary, with notice to you. There is no charge for your first request in any 12-month period. Where our Site receives a recognized universal opt-out mechanism, such as Global Privacy Control, we treat it as a request to opt out of targeted advertising and the sale of personal data for that browser and device. You may also use an authorized agent to submit an opt-out request on your behalf.

Right to appeal. If we decline to act on your request, we will notify you and explain our reasons. You may appeal by emailing support@onrampfunds.com with the subject line “Texas Privacy Appeal.” We will respond to your appeal within 60 days. If we deny your appeal, we will provide you with a method to submit a complaint to the Texas Attorney General.

Relationship to federal financial privacy law. Much of the information we collect in connection with providing financing is nonpublic personal information governed by the Gramm-Leach-Bliley Act, which is exempt from the TDPSA. This section applies to personal data that is not subject to that exemption.

GLBA Notice — Federal Financial Privacy (Gramm-Leach-Bliley Act and Regulation P)

This section describes how Onramp Funds handles “nonpublic personal information” (“NPI”) — the personal information we obtain about you in connection with providing financial products or services that is not otherwise publicly available — consistent with the federal Gramm-Leach-Bliley Act (“GLBA”) and its implementing Regulation P. It supplements the rest of this Privacy Policy.

Nonpublic personal information we collect. The NPI we collect depends on the products and services you obtain from us and may include information such as your name and contact details, Social Security number or taxpayer identification number, date of birth, bank and financial account information, income, transaction and payment history, and credit history and credit scores. The categories of information we collect and the sources we collect it from are described in the “Information We Collect” section above.

How we share nonpublic personal information. We share NPI only as described in this Privacy Policy and as permitted by law. We do not sell your NPI. We may use NPI to market our own products and services to you, and we may share NPI with nonaffiliated third parties that perform marketing services on our behalf, under contracts that require them to maintain the confidentiality of the information and to use it only for the services we request, as permitted by federal law. You may ask us to stop using your contact information for marketing at any time by emailing support@onrampfunds.com. We may share NPI for our everyday business purposes — such as to process your transactions, maintain and service your account(s), collect amounts you owe (including through collection agencies and attorneys), respond to court orders, subpoenas, and legal or regulatory investigations, obtain legal or professional advice, and report to credit bureaus — and with service providers and our affiliates that perform services on our behalf under contractual confidentiality and use restrictions. Each of these disclosures is made for everyday business purposes or as otherwise permitted by law and is not subject to an opt-out under federal law.

Your right to limit sharing. Federal law gives consumers the right to limit certain sharing of NPI — specifically, sharing information about your creditworthiness with our affiliates for their everyday business purposes, allowing our affiliates to use your information to market to you, and sharing with nonaffiliated third parties so that they can market to you. Onramp Funds does not share your NPI in any of these ways, so no opt-out is necessary. If our practices change, we will update this notice and provide any opt-out required by law before we begin any such sharing.

How we protect nonpublic personal information. We maintain physical, electronic, and procedural safeguards designed to protect NPI and to comply with applicable federal and state law, including access controls and encryption in transit, as described in the “Protection of Information” section above. We limit access to NPI to personnel who need it to provide our Services.

Former customers. If you close your account or your relationship with Onramp Funds ends, we continue to handle your NPI in accordance with this Privacy Policy and applicable law.

Changes to Our Privacy Policy

We reserve the right to modify this Policy at any time. If we decide to change our Policy, we will post those changes to this Policy on our Site’s homepage and any other places we deem appropriate to make you aware of the changes. If we make material changes to this Policy, we will notify you via email or by means of a notice on our homepage prior to the changes becoming effective.
